1. Overview. This website is operated by Not Yet Buried ("we", "us"). By visiting the site or buying from us, you agree to these terms. If you do not agree, please do not use the site. We may update these terms at any time by posting the new version here; continuing to use the site means you accept the changes.
2. Using the site. You must be at least the age of majority where you live, or have a parent's or guardian's permission, to buy from us. You may not use the site for anything unlawful, to infringe anyone's rights, to upload malicious code, to collect other people's personal information, or to interfere with the site's security.
3. Accuracy of information. We work to keep product information, colours and measurements accurate. Screen colours vary, and made-to-order garments can differ from the listed measurements by up to about 1 inch (2 inches on some tees). We may correct errors, update information or cancel orders affected by an obvious error (for example a wrong price) at any time, before or after an order is placed; if we cancel, you get a full refund.
4. Products and made-to-order production. Our products are made to order by our production partner after you buy. Production usually takes 2-7 business days, then shipping. Some on-model photos are AI-styled; the garment and the print shown are the real product. Products are available while we offer them and we may discontinue any product at any time.
5. Prices, payment and shipping. Prices are in US dollars and may change without notice, but the price shown at checkout is the price you pay. Shipping is free on US orders. Sales tax is added at checkout where it applies. Payment is processed by Shopify and its payment partners; we do not see or store your full card number.
6. Orders. We may refuse or limit any order, including orders that appear to be placed by resellers or that use fraudulent payment details. If we cancel an order after you are charged, we refund it in full.
7. Returns and refunds. Our refund policy (linked in the footer) is part of these terms: misprints and damage are reprinted or refunded, fitted women's pieces get one free size remake, and there are no change-of-mind returns.
8. Third-party tools and links. The site may include tools or links from third parties (for example payment, reviews or social media). We do not control them and are not responsible for their content or practices; use them under their own terms.
9. Your comments and submissions. If you send us reviews, photos or other content, you confirm it is yours, true and lawful, and you allow us to display it in connection with our store. We publish reviews as written (we may remove spam, hate speech or personal information) and never invent reviews.
10. Personal information. Our privacy policy (linked in the footer) explains how we handle your information.
11. Intellectual property. The Not Yet Buried name, the NYB monogram, our designs, photos and text belong to us. You may not copy or sell them without our written permission.
12. Disclaimer. Except as stated in our refund policy and as required by law, the site and products are provided "as is" without warranties of any kind. We do not guarantee the site will be uninterrupted or error-free.
13. Limitation of liability. To the extent the law allows, we are not liable for indirect, incidental or consequential damages arising from your use of the site or our products. Our total liability for any claim is limited to the amount you paid for the product involved.
14. Indemnity. You agree to cover us for claims arising from your breach of these terms or your misuse of the site.
15. Severability and entire agreement. If any part of these terms is unenforceable, the rest still applies. These terms, together with the policies linked in the footer, are the whole agreement between you and us about the site.
16. Governing law. These terms are governed by the laws of the State of Texas and applicable US federal law.
